The Irish Waste Management Association has lodged a complaint about the proposed incinerator at Poolbeg, calling Dublin City Council’s contract for the facility "anti-competitive and illegal".
The complaint was lodged with the Competition Authority and is now under investigation.
The Association contends that the deal between the Council, Coyanta Energy and DONG Energy Generation is anti-competitive and, therefore, illegal and void.
The complaint also claims that the Council is attempting to use is position to influence the waster market in order to favour the Poolbeg incinerator to the detriment of competitors.
Dublin City Council has said it will respond to the complaint, but will continue to work on the site of the planned facility in the meantime.
Some reports have suggested the complaint represents the last chance objectors of the incinerator have to derail the project.
