Labour TD Kevin Humphreys is calling for the Poolbeg Incinerator contract to be scrapped despite the EU ruling.
Mr Humphreys said: "Despite the decision of the EU Commission that the Poolbeg Incinerator project did not breach State aid rules today, it should still be scrapped as it is a major waste of public money, and a legacy of another era.
"Dublin City Council has already spent €96 million on the project and a further €10 million on a useless district heating system bringing to €106 million the amount wasted so far.
"The revised project would still have to approved by the National Development Finance Agency and then by the project board. Dublin City Manager Owen Keegan has also said he will seek the views of City Councillors before going ahead with the project.
"I would call on him to ensure no decision is made until after a new city council is elected, and like many who have opposed it since its inception, I believe it should be scrapped."
