A Northern Ireland district council is facing legal proceedings following an alleged breach of health and safety, which led to an employee's death.
The digger driver was working for Fermanagh council at an Enniskillen landfill when he was killed.
Ronnie Marshall's vehicle is believed to have fallen into a gully at the Drummee site in April last year.
It is though the ground below the digger gave way, causing the incident.
Mr Marshall was transfered to hospital but died from his injuries 10 days later.
The case is scheduled to be heard at the crown court in Dungannon next month.
