Couple Awarded Damages For Defective House

A Co Mayo couple have been awarded €310,000 in damages arising from defects incurred during the construction of their home.

Graham and Sharon Mussett sued Alan Piper, trading as Alan Piper Developments over the defects and engineer James Maloney, of James Maloney and Associates, over alleged negligent mis-statement in the certificate of compliance with building regulations relating to the house.

The couple cited multiple defects at their Ballina home, including a geothermal heating system which did not work properly and a "substandard" effluent treatment system which resulted in the garden becoming waterlogged with semi-treated waste-water.

The High Court awarded the damages, despite the defendants denying the claims.
