Quarry Director Agrees Disqualification

The Department of Enterprise, Trade and Investment has accepted a disqualification undertaking for seven years from the director of Quarry-Fix Limited.

Ivor Davison (42) of Mountview Place, Moneymore, Magherafelt has been disqualified in respect of his conduct.

The Company carried on the business of the manufacture of concrete batching plants and went into liquidation on 13 November 2008 with unknown assets, liabilities of £459,665 to non preferential creditors, and a deficiency as regards creditors of £459,665.

After taking into account the losses incurred by one member (shareholder) of the Company the total estimated deficiency was £459,666.

The Department accepted the disqualification undertaking from Ivor Davison on 28 February 2011 based on the following unfit conduct which solely for the purposes of the disqualification procedure was not disputed:

a) failing to co-operate with the Official Receiver in contravention of Article199(2) of the Insolvency (Northern Ireland) Order 1989 in that he failed to attend the Official Receivers office as requested and failed to deliver up accounting records and other information;

b) causing and permitting the Company to retain £258,737, properly due to the Crown in respect of PAYE tax, NIC and VAT; c) failing to comply with Article 235 of the Companies (NI) Order 1986 in that accounts for the year ended 31 December 2007 were not filed with Companies Registry.

The Department has accepted 39 Disqualification Undertakings and the Court has made three Orders disqualifying three directors in the financial year commencing 1 April 2010.
